On the Issue of the Factoring Contract’s Legal Nature

Summary/Abstract: This article aims at answering some questions regarding the legal nature of the factoring contract. The author provides an answer to the question whether the factoring contract can be reduced to a treaty of cession. The factoring has been observed in the light of the lending relations. There are some arguments that are adduced against the understanding of the factoring contract as a form of a fiduciary cession. In this sense the author has brought attention to some particularities and controversial points in theory and practice. A conclusion has been drawn that during a research of this type of contract the specifics related to its genesis should be reported, thus its „transfer“ in a „foreign environment“ makes its automatic inclusion in it impossible.
