Proceedings by Default under the Criminal Procedure Code

Summary/Abstract: The author studies the regulation of the criminal proceedings by default under the Criminal Procedure Code. The importance of the proper balance between the right of the accused person to take part in the proceedings, and the social interest to reveal the truth about the committed crime, is underlined. The Criminal Code’s provisions are examined regarding the obligatory and not obligatory participation of the accused in person in the court’s hearing; the prerequisites of the proceedings by default; as well the legal guarantees for the realisation of the right to defense in the proceedings by default.
