Interpretative Decision No. 2/2001 of the General Meeting of the Civil College at the Supreme Court of Cassation — Five Years Later

Summary/Abstract: The article provides an analysis of the interpretative decision, which had considered important practical issues with regard to property community where one of the spouses is self-employed or has stocks and shares in commercial companies. The arguments of formal nature in the decision’s motives are distinguished as well as alternative criteria are taken into consideration, such as the lack of contribution, the objects included in the property community and the special use of the business establishment and the possessions it comprises of. The issue regarding the craft enterprise of one of the husbands is examined. Suggestions de lege ferenda based on the analysis are made in view of the elaboration of a new Family Code Draft.
