On Some Issues Concerning the Functions of the Earnest under Art. 93 of the Obligations and Contracts Act

Summary/Abstract: This article aims at answering some questions regarding the affirmative and guarantee functions of the earnest. It also seeks for an explanation whether the earnest is a guarantee. The author makes an attempt to give reasons for the concept that Art. 92 (2) of the Obligations and Contracts Acts is not applicable in respect of the earnest. These issues have practical significance for the business.
