Summary/Abstract: In the context of instating the state of emergency, in cases of extreme urgency when the court proceedings continue, including during the state of emergency, there is a possibility that the court hearings be conducted by video conferencing, while such possibility was also maintained by the decree whereby the state of emergency was extended. The analysis comprises specific clarifications on the observance of the principle of publicity of court hearings should the hearing be conducted by video conferencing, while also providing answers to the following questions: Is the principle of publicity of court hearings observed during the state of emergency? Where, however, during the state of emergency, a party considers that the principle of publicity of court hearings is not observed as a result of the court hearing being conducted by video conferencing, which are the procedural means to be used to invoke such matters? Once the state of emergency is over, can the court hearing still be conducted by video conferencing?
