Summary/Abstract: Analysis based on the analogy between the principle of separation of and the managerial principle of the functions of an organization reveals the criterion underlying the separation of power in the state. The proposed theory argues that the three powers of the state: (1) the legislative power, (2) the executive power, and (3) the judiciary, derive and overlap, accordingly, with the three functions of an organization: (1) decision (2) implementation and (3) control. This analysis establishes the criterion underlying the separation of power and answers the question of why the sovereignty of the state is divided into 3 powers and not n powers. In the second part, the study details the correspondence between each function of the organization and the related state power.
