Summary/Abstract: This study is devoted to the issue of the subsequent inability to provide services by an agricultural producer under a cultivation contract, in a situation where the inability to perform an obligation is a consequence of circumstances for which neither party is responsible. The legislator has specifically regulated the inability to provide services by an agricultural producer in art. 622 of the Civil Code. However, for a full analysis of this issue, it is necessary to refer to the provisions of the general part of the law on obligations. The current legal regulation puts the risk of the agricultural producer in too asymmetrical way. Therefore, the current legal status has been critically addressed.
