Summary/Abstract: The following contains a brief analysis of some of the important aspect regarding the medical staff and suppliers’ liability for malpractice. Given the complexity of the topic it is impossible for it to be fully analysed through an article of a scientific journal, however my purpose is to point out and suggest solutions for certain interpretation, appliance and “capitalization” of the juridical norms related to medical malpractice in a civil lawsuit. The focus of the material consists in discussions on the exoneration cases of liability of the personal staff and on some of the essential civil procedural pleas in a medical malpractice litigation.
