Summary/Abstract: The approach of the principle of subsidiarity could be ambivalent, federalist or nationalist one, but it is sure that nowadays the European Union uses often this principle for adopting measures in according with the EU objectives. The principle of subsidiarity regulates the exercise of the Union’s non-exclusive powers, meaning the shared and complementary competences. The Member States keep the control on the respect of the principle of subsidiarity without any power to block a legislative act proposed by the European Commission. The Romanian Parliament seems to be aware on the important democratic character of the political control laid down by the Protocol no. 2 and the reasoned opinions or opinions elaborated in this regard are the proof of its involvement. In the meantime, the Court of Justice of the European Union has the competence to check if the European legislative institutions respect the EU Treaties when they consider that the objective of the proposed action could be better achieved at Union level. For the future, the principle of subsidiarity will be used for motivating the European legislative proposals necessary for the achievement of the European Union’s goals and for the benefit of the European citizens.
