Summary/Abstract: An overview of the recent legal literature on the topic revealed the lack of a unitary analysis, both from a substantial and procedural point of view, related to conducts that tend to obstruct judicial proceedings by concealing, destroying or altering evidence. Such approach is necessary to highlight the particularities of the strictly criminal regime in relation to the criminal procedural one, but also to clarify the margin of action of a person subject to criminal proceedings in relation to the standard of non self incrimination.
