Summary/Abstract: The article takes notice of the necessity to separate intersecting scopes of the regulated legal activities performed by advocates, attorneys-at-law, patent attorneys and partially by notaries and non-regulated (free) legal activities performed by anyone on the basis of the principle of economic freedom. Both of these legal activities are classified under the same subclass (69.10.Z) of the PKD (Polish Classification of Activities), although according to the obligatory regulations the conditions for undertaking and performing them are mutually exclusive. The article comprises of findings concerning the nature, scope and effects of the defectiveness of the legal activity regulation in Polish law and indicates de lege ferenda the possible methods of fixing it. The results of the conducted research have a significant meaning not only for the rule of law but also for the proper functioning of the Polish legal services market.
