Summary/Abstract: The study aims at analysing the structure of Romanian criminal trial as perceived through a traditional common-law institution: judicial caesura. Considering the importance that should be attached to debates on the nature and amount of punishments, is such a cleavage trial convenient? Which are the essentials, the purposes and the advantages of such an institution? Which are the dangers which may affect the enshrined procedural guarantees? Does Romanian criminal procedure afford such an innovation? These are but a few questions and answers on which the author’s ideas are focused.
