Summary/Abstract: The EIO is a judicial decision issued or validated by a judicial authority of a Member State in order to comply with one or several specific investigative measure in another Member State to obtain evidence and / or transmission of evidence that is already in the possession of the competent authorities of the executing state, which excludes other forms of assistance that do not aim to obtain evidence or for that there is a simpler procedure of transmission or execution. EIO has been transposed into national legislation which, in certain cases, which we intend to analyze, lacks rigor and clarity.
