LIABILITY OF THE AUTHORIZED NATURAL PERSON AND THE INDIVIDUAL ENTERPRISE

Summary/Abstract: The authorized natural person and the individual enterprise constitute forms of organization of the natural person in order to carry out an economic activity independently. The liability of the authorized natural person and of the individual enterprise, whether we are talking about patrimonial liability or criminal liability, has created in practice a series of controversies and in some cases has generated non-unitary jurisprudence. Clearly, given the importance of these forms of organization, it is necessary to identify concrete solutions for a common approach and a correct prediction of how other entrepreneurs can collaborate in the economic activity with these structures.
