CONTRIBUTORY NEGLIGENCE IN CONTRACTUAL LIABILITY AS A CONSEQUENCE OF A BREACH OF A SPECIAL OBLIGATION

Summary/Abstract: The article examines different theories on the nature of contributory negligence, such as “selfresponsibility”, material burden and Obliegenheiten. Attention is paid to the origin of these theories in a comparative legal aspect. It is considered whether these understandings can be justified in application of Art. 83, § 1 of the Law of Obligations and Contracts.
