Summary/Abstract: Resulting from Article 23 of the Polish Family and Guardianship Code (abbreviated: FGC), the obligation of mutual assistance of spouses covers all actual acts of one of the spouses supporting the other in the exercise of their rights and obligations arising from marriage. The obligation of mutual assistance of spouses is closely connected with the obligation of their cooperation aiming at the good of their family, which includes all activities that are needed for the proper functioning of the family, including the proper upbringing of children and refraining from behaviors that could harm the interests of the family as a whole as well as its individual members. The spouses’ obligations regarding mutual assistance have been specified and developed in Article 27 of FGC from which it follows that spouses are obliged, according to their own strengths and their earning and financial means, to contribute to satisfy the needs of their family. This obligation serves the satisfaction of the justified needs of the whole family group, and therefore meeting it should take into account the collective needs of the family (e.g. housing, fuel, electricity) and the individual needs of the family members (e.g. food, clothing, housing, personal hygiene, health protection). The current practice of applying these provisions indicates that the obligation of mutual assistance and the obligation to cooperate for the good of a family refer to making efforts to satisfy the living needs of the family and mutual support of the spouses in fulfilling their marital and family obligations.
