Summary/Abstract: Illegal migration is often referred to as an entry or stay in a particular in violation of the law of this country related to the hosting of refugees. A dwelling without permission in the particular country entails, among others, an illegal entry to its territory. In the Polish Penal Code, the legislator envisaged the responsibility for irregular entry into the Republic of Poland in contrary to the regulations of law from article 264. Trespasses, determined in this regulation, are presented within the limits of the coverage. Reflections include also remarks concerning the range of the illegal migration phenomenon in Europe and instances of violation of article 264 of the Penal Code in the Polish reality.
