Summary/Abstract: Principles of necessity and no nuisance of subpoena in the Polish administrative procedure. The proper course of administrative proceedings depends to a large extent on the proper flow of information between a administration authority and other participants in the proceedings. The administration authority messages can be of informative or imperious nature – ordering specific action. The second category includes subpoena. They oblige their addressee to take specific actions. They therefore constitute interference with the freedoms of the person summoned. Due to the above, the legislature provided for certain restrictions in their application, preventing administration authority from abusing its dominant position. The key are the principles of the necessity of Subpoena and the no onerous of Subpoena. They are intended to protect the addressees of the subpoena against the imposition of unnecessary obligations or onerous form of performance of obligations, if this is not necessary.
