Rewarding as a part of cultural policy: administrative issues

Summary/Abstract: Background: The presented study is concerned with administrative aspects of honoring cultural activities as part of cultural policy in Poland. Research purpose: To determine cultural policy as an essential element of public strategy aimed at the sustainable development of society. The author claims that rewarding cultural achievements by government and local government authorities cannot be the result of opportunistic activities, but rather should be an expression of a long-term cultural strategy. Methods: The research is based on a dogmatic analysis of the provisions of Polish law including local law, case law, and doctrine in the context of international and EU law. Conclusions: As a result of the above considerations, the author concludes that public authorities have a very wide range of discretion in rewarding outstanding cultural people. These activities – in general – are not subject to any form of judicial review. A fundamental role is played by constitutional principles and the so-called internal limits of free discretion determined by specific moral and ethical imperatives, such as the common good or administrative policy.
