Summary/Abstract: The principle of the Rule of Law is one of the fundamental systemic values included in Art. 2 of the Treaty on European Union. It was developed in the jurisprudence of the EU Court of Justice and specified in detail in the Regulation of the European Parliament and the EU Council of 16 December 2020. The regulation strengthens the competences of the European Commission and its autonomous function as the guardian of compliance by the Member States with the Rule of Law. This study analyses of the genesis of the Rule of Law in primary EU law together with the exegesis of the Regulation on the general regime of conditionality, paying attention to the systemic realization of the Rule of Law, the normative approach related to it and systemic limitations to its application. It was assumed, as a research hypothesis, that the development and realization of the Rule of Law in primary law, as well as its normative expression in secondary law, constitute an important step in strengthening the systemic foundations of the EU’s functioning combined with the possibility of enforcing compliance by the European Commission with the Rule of Law by the Member States.
