Summary/Abstract: Romanian Labor legislation and specific normative acts allow reducing the working time of the employees, and, in certain situations, impose to reduce the working time of employees. Given the variety of situations in which the reduction of working time may occur, it should be noted that both the related wage rights and social security rights are determined differently depending on the situation that led to this reduction in working time. Starting from the definition of the salary, which represents the value of the work performed by the employee, we will notice that the employees who work less hours than their work norm, in some situations are fully remunerated, in other situations have the right to receive certain allowances, and in other cases there is no obligation for the employer to remunerate the time not worked due to the reduction of the work schedule. One of the most discussed situations of reduction of working time in the last period is the one regulated by GEO 132/2020 (Kurzarbeit). In this article I analyzed in detail the situations in which can arise the reduction of the employees’ working time and the different treatment of this reduction from labor legislation point of view and from the perspective of salary and social insurance rights.
