Summary/Abstract: Taking into consideration that starting with 2003, when entered into force the Law 53/2003 - Labor Code, many legislative changes have taken place, and also the way in which the working relations are developed has changed significantly, I made an analysis of working time and labor related rights. The determination of working time itself has created many problems of interpretation, so that in many cases have been asked the resolution of the European Court of Justice. Thus, in this area, the case law of the European Court is rich in many interpretable cases. In this article, I analysed some of them. For the correct organization of working time in the unit, it is necessary to take into account all legal provisions regarding the maximum working time, overtime and prohibitions on overtime work, compliance with daily rest and weekly rest, the days of legal holiday, prohibitions regarding night work, etc. All these elements should be seen as a global picture and analysed together. Therefore, in this article I analyzed also these aspects.
