PARTICULARS OF THE ACTIVITIES CARRIED OUT BY THE JUDICIAL AUTHORITIES IN ORDER TO IDENTIFY THE UNKNOWN AUTHORS IN CAUSES OF LEAVING THE SCENE OF TRAFFIC ACCIDENTS FOLLOWED BY THE DEATH OF THE PERSON

Summary/Abstract: This article draws the attention of its readers to the issue of the investigation of traffic accidents followed by the death of the victim, whose author left the scene of the deed and the specifics of the main activities that the judicial authorities have to carry out in order to identify the perpetrator and to resolve the case urgently. The first chapter is devoted to the general considerations regarding the regulation of the activity of receiving, recording and solving petitions (complaints, claims, submissions), in which it is to be revealed by whom (citizen, legally established organisation), how (in writing or by e-mail) and to whom (central and local public authorities and institutions, decentralised public services of ministries and other central authorities, national companies, county or local commercial companies and autonomous administrations, hereinafter referred to as public authorities and institutions) the petitions may be addressed, as well as their ranking. Chapter 2 presents the procedure for recording criminal cases with unidentified authors, illustrating the steps that the police officer should undertake before and after recording the case in rem, until the file is reopened when solid evidence or new elements appear related to the circumstances in which the deed was committed and to the perpetrator. Chapter 3 deals with the main issues that must be clarified in the forensic investigation of the crime of leaving the scene of the traffic accident followed by the death of the person, in case the author left the scene of the accident: determining the nature of the social relationships harmed (the special legal object and the material object), the subjects (active and passive), the material element (the objective side) and the form of guilt (the subjective side), that is, the concrete offense / offenses committed. The last chapter deals succinctly with the peculiarities of the main activities that the judiciary authorities have to perform in order to administer the evidence and solve the case: on-site research, hearing eyewitnesses, forensic technical-scientific findings, forensic expertise, developing working hypothesis and circles of subjects.
