Summary/Abstract: Domestic violence is an extremely widespread phenomenon both globally and nationally, and settlements in courts for cases having as object “protection order” are a real challenge for them, generated by the high number of cases with this object, the speed which it is judged, as well as the need to ensure a balance between the principle of availability in the civil process and that of the active role of the judge in finding out the truth. In this study, the author aims to highlight the difficulties encountered by judicial practice, leading to a series of jurisprudential differences on the interpretation and application of special rules governing this matter.
