Summary/Abstract: In this article we shall deal with the principle of equality between men and women, which reprezent a value and an objective of the European Union, more precisely about equality at work. This principle was consecrated since the beginning of the European Communities, in the founding treaties, but only for salaries, then its scope expanded at all the aspects of the work and of the social security. The jurisprudence of the Court of Justice also has contributed to this, which, as in other fields, has often obliged the authors of the treaties and the Union legislator to take into account the evolution of the society and of the habits. The legislation of the Union is not, however, exempted of criticism form the part of the scholar litterature, some authors considering that it has a passivist approach, of fighting discrimination and not of promoting full equality, and that it focuses rather on the effects than on the causes of the discriminations.
