Summary/Abstract: A reflection on the concept of formal justice introduced into the language of theory by Chaim Perelman, using the analysis of George Orwell’s novel "Animal Farm" as an example. Perelman defines formal justice as equal treatment of people who belong to the same relevant category. However, according to him, the application of the principle of formal justice in practice requires that the criteria for the designation of categories considered important be defined beforehand. The distinction of these categories is – and herein lies the problem I have emphasized – in itself not only a question of morality, but also of justice. So does the principle of formal justice solve the problem of equal justice?
