Summary/Abstract: The article summarises the case law on the problem of the commercialisation of the image and the compensation for the damage caused by its use in advertising. Moreover, it points to a significant change in the approach of Polish courts to the nature of this right. The right to image, traditionally understood as a right protecting non-property interests, with the transformation of the economic system, started to show features of a property right. This transformation also affects the catalogue of claims available to a person whose image has been unlawfully used.
