Summary/Abstract: The subject of the article is the issue of divisibility of the contractor's performance in a construction contract. The article discusses the concept of divisibility of performance within the meaning of Article 379 § 2 and Article 491 § 2 sentence 1 of the Civil Code. The prerequisites for recognizing a benefit as divisible within the meaning of the above regulations are characterized. The analysis covers the issue of divisibility of the contractor's performance in a construction contract, especially, in view of the application of Article 379 § 2 and Article 491 § 2 of the Civil Code. Reference is also made to the consequences of applying the above regulations to a construction contract.
