Summary/Abstract: The article discusses the problem of trade secret in the public procurement procedure in Poland. It explains the notion of trade secret under the Unfair Competition Act and the Public Procurement Act. In addition, the axiological justification of this institution is given. The article also indicates procedural requirements related to confidentiality of the enterprise and the consequences resulting from a failure to comply with them.
