Summary/Abstract: Gender-based violence disproportionately affects women, whose identification as a vulnerable group raises several sensitive questions for the theory and practice of human rights protection. The report attempts to clarify the understanding of the rights of vulnerable groups and gender-based discrimination. The jurisprudence of the European Court of Human Rights is presented in the context of the application of Art. 1 of the European Convention on Gender-Based Violence against Women. The article traces the contribution of the ECHR to the expansion of the scope of the prohibition of discrimination and the adoption of the Council of Europe Convention on preventing and combating violence against women and domestic violence (Istanbul Convention).
