Summary/Abstract: Nowadays, the right to life is more and more debated. Abortion, medically assisted procreation and euthanasia represent daily topics of discussion. Given the sensitivity of the questions relating to the right to life, “the national margin of appreciation” is highlighted. It is unanimously recognized that it involves cultural, social, economic, medical or legal factors. Our research shows that, in the perception of the Christian-orthodox jurists working at the European Court of Human Rights and having agreed to be part of our sample, the religious factor is also a defining element of the margin of appreciation invoked in the context of the article 2 of the European Convention on Human Rights and Fundamental Freedoms
