Summary/Abstract: The judiciary protects the rights and legitimate interests of citizens, legal persons and the state. On the basis of this criterion – a function of legal protection – the judiciary is structured, with the prosecution and the investigation as well as the courts. But the other two authorities, and in particular the executive, have such a human rights function. The bearer of the jurisdiction is the court. Therefore, the bearer of the judiciary is only the court, according to its main function – the justice.
