Summary/Abstract: The book is published as a result of the national scientific conference “Protection against discrimination: legal regulation, problems and tendencies”, which took place at 8 June 2018 in the University of Economics – Varna. The scientific forum was organized by “Legal sciences” Department of University of Economics – Varna in partnership with the Institute for Legal Studies - unit of the Bulgarian Academy of Sciences and the Commission for Protection against Discrimination. The Conference was organized in the frame of Activity 7 Organization of national and international scientific forums for distribution of the scientific production of doctoral, post-doctoral students and lecturers” of Project “Investments in the education of students, doctoral, post-doctoral students and lecturers – guarantee for better future”. The Project is finances by the "Intelligent Growth Science and Education" Operational Program, supported by the European Union through the European Structural and Investment Funds.

- Summary/Abstract:Legal consciousness is one of the most important factors that plays significant role in the process of implementation of non-discriminatory laws. The study reports results from a representative empirical legal-sociological research on legal consciousness and (non)discriminatory bahavior in the context of some very specific ethnic differences in Bulgaria. This indicates that public opinion about discrimination can play an important part in the preparation of the new non -discriminatory legislation.

- Summary/Abstract:All human beings are born free and equal in dignity and rights. (Art. 1, Universal Declaration of Human Rights, Art. 6, Paragraph 2). According to Art. 6, paragraph 2 of the Constitution of the Republic of Bulgaria there shall be no privileges or restriction of rights on the grounds of race, nationality, ethnic self-identity, sex, origin, religion, education, opinion, political affiliation, personal or social status or property status. The grounds for non-discrimination turn equality into a politically easy to misuse category into an objectively recognizable value. On the other hand Equality of Differences often capitalize on these differences. This is a logical result of the current protection against discrimination.

Although it regulates the issue of equal treatment only by gender, it clearly raises the problem of discrimination in the real sector in which the exchange of goods takes place. Until the adoption of this directive, the emphasis in European anti-discrimination legislation is mainly on the employment and education sectors. - Summary/Abstract:There are two EU legal acts regulating the cross-border healthcare – namely the social security Coordination Regulations and the Directive 2011/24/EU on the application of patients’ rights in cross-border healthcare. The principle of equal treatment and the non-discriminatory criterion on the ground of nationality along with the risk of reverse discrimination in respect of the non-mobile patients compared to the mobile ones are problems of major importance to European doctrine and jurisprudence and thus special attention is paid to them in this report.

- Summary/Abstract:The right of persons with disabilities to targeted benefit under art. 19 of the Rules of implementation of the Social Assistance act on a free public transportation trip twice a year, using railway transport within the country, creates less favorable treatment for persons with permanent disabilities living in areas without built railway network and constitutes direct discrimination on grounds of „personal status“ and „disability“ and is in violation of art. 4, para. 1 of the Protection against Discrimination Act.

- Summary/Abstract:The Constitution and the Family Code of the Republic of Bulgaria promulgate the equality of the children born in marriage, outside marriage and the adopted children. The children born in marriage have their established descent by force of the marriage itself. The children born outside marriage should have established descent, so that they could make use of their recognized equality with the children born in marriage and the adopted children. The adopted children, however, even if they may have no established descent, are vested by the law with the same rights as the children with proven parental descent.
