Summary/Abstract: The article considers the question of procedure of the election of the President of the Republic of Poland in the context of president’s constitutional functions and tasks. It includes analysis of legal and political aspects of the universal elections of the President of the Republic of Poland, according to the legal solutions, adopted in the Costitution of 2nd April 1997. The author of this article make an assessment of the procedure of the election of the president in universal and direct elections. In his opinion, this procedure is non – conformity to the scope of presidential functions adopted in the Constitution. In political practice, from time to time it implies conflicts in the relationships between the President of Republic and the Council of Ministers. Moreover, it impairs the authority of the president, as a neutral arbitrator and moderator of political scene in Poland.
