Summary/Abstract: Human rights are the main sources of refugee rights as refugee rights are born because of human rights violations. To be more specific, refugee flows happen because of human rights violations. In the beginning the violations start in the country of origin; people leave their country because of human rights violations and they become refugees. Then most of the times same or another kind of violations continue during the “journey” to third party countries where the refugees try to apply for asylum. Finally, when the refugees arrive to third countries, they have to wait under different temporary status, and not always the best status for human rights, based on the migration law of third countries. In other words, the human rights of refugees are violated gradually between their country of origin and the asylum country. However; as it is mentioned by UN Office of the High Commissioner for Human Rights (OHCHR) the refugees’ rights should be respected prior to, during and after the process of seeking asylum.
