Summary/Abstract: At the end of 2018, Japan announced that it was withdrawing from the International Convention for the Regulation of Whaling and leaving the ranks of the International Whaling Commission. The reason for this is disagreement with the ban on commercial whaling, which has been in force for parties to the Convention since 1986, and the decision to resume this hunt from the summer of 2019. The text first explains the development and setting of the international legal regime for the protection of whales and the history of Japan's relationship with it. It then shows that Japan's efforts to justify the resumption of commercial whaling with the principle of sustainable use of living marine resources cannot succeed for practical and normative reasons.
