Summary/Abstract: In this text author pointed out the influence of a Decision of Constitutional Court of Bosnia and Herzegovina on election of members of Municipality Council of city of Mostar. The author expresses his attitude that the Decision of Constitutional Court of Bosnia and Herzegovina was not legal recommendation for managing local elections in Municipality of Mostar. But, since elections are not held, the opinion of author is (for which he is providing the legal arguments) that by the relevant interpretation of constitutional and statutory provisions could be reached reliable legal conclusion that the Municipality Council of the Mostar, which four-year term has expired, may continue its functioning and fulfill its obligations under its jurisdiction until a new Municipality Council is elected, and such functioning is based on the principles of constitutionality and legality.
