Summary/Abstract: Despite an established defense system, there is no method of flood protection that is absolutely efficient. Nevertheless, that does not mean that there is no liability for improper conduction of flood protection measures. In Croatian legal system there are two types of protection against the improper conduction in flood protection measures: traditional, tort law based liability for damage, and newly established protection of misconduct of public authorities, prescribed by the rules of public law. The subject of this paper is analysis of two mentioned types of protection against the improper conduction in flood protection measures in Croatian legal system.
