Prof. Marián Mark Stolárik, Ph.D. (Martin 1943) graduated from the Universities of Ottawa and Minnesota. In the 1970’s and 1980’s he lectured at the Cleveland State University and was the President of the Balch Institute for Ethnic Studies in Philadelphia. Since 1992 he has been Professor and Chairholder of the Chair in Slovak History and Culture at the University of Ottawa in Canada. Prof. Stolárik specializes in the history of immigration and ethnic groups in North America with emphasis on the Slovak experience. He is the author or editor of ten books and more than sixty articles in scholarly journals, including Slovaks in Bethlehem, Pennsylvania, 1880–1976 (1985), Immigration and Urbanization: The Slovak Experience, 1870–1918 (1989) and Where Is My Home? Slovak Immigration to North America (1870–2010) (2012). He edited The Slovak Republic: A Decade of Independence (2004) and The Czech and Slovak Republics: Twenty Years of Independence, 1993–2013 (2016). He served as a consultant and contributor to The Harvard Encyclopedia of American Ethnic Groups (1980) and to The Encyclopedia of Canada‘s Peoples (1999). Founder of The Slovak Studies Association (1977), he also founded and edited The Slovak Studies Newsletter (1977–1987); Now he is editor of the scholarly annual Slovakia (since 1982) and serves on the Literary Committee of the National Slovak Society which, since 1892, has published the popular Národný kalendár (National Almanach). Prof. Stolárik is married to the former Anne Ivančo and has two sons, Andrej and Matúš, whom he raised in the Slovak language.

The principle of law of the availability implicitly includes the possibility granted by the lawmaker to the parties to perform proceeding disposition acts. As regards relinquishing the legal action, the Civil Procedural Code applicable to date included, in art. 406, para. 5, an apparently irrelevant amendment; however, the jurisprudence shows this cannot go ignored, as the premises of party damage proved to be present. Therefore, this paper aims at sounding the alarm on the potential consequences of annulling previous Court Orders in case of relinquishing the legal actions during the appeal proceedings or in the extraordinary legal remedies, which, as proven by the jurisprudence in Court, may lead to important losses for the Party that is not at fault.

Uniemożliwiona została na kilka lat działalność Kurii Biskupiej i Seminarium Duchownego, a jego alumnów rozproszono. Jedna trzecia duchowieństwa diecezji łódzkiej zginęła w obozach koncentracyjnych. Niemalże wszystkie kościoły położone w tzw. „Kraju Warty” zostały przez hitlerowców obrabowane i zamienione na magazyny.
More...Pojęcie „służba publiczna” jest stale obecne w dyskursie dotyczącym organizacji i funkcjonowania państwa. Używa się go w różnych znaczeniach, przede wszystkim dla nazwania kadry urzędniczej i podejmowanych przez nią zadań, ale także w szerszym, tj. dla określenia wszelkich aktywności ukierunkowanych na dobro innych osób. O ile drugie z wymienionych znaczeń ma charakter ponadczasowy i uniwersalny, o tyle pierwsze z nich warunkowane jest typem państwa i prawa, w którym administracja jest tworzona oraz funkcjonuje. Przedmiotowe zagadnienie zyskuje więc na aktualności w obliczu zmian zachodzących w ostatnich latach w obrębie prawa administracyjnego (mowa tu choćby o wyposażaniu w kompetencję administracyjną kolejnych podmiotów), jak również w kontekście aktualnych napięć w obszarze współdziałania władz publicznych.

More...This special issue of Studia Universitatis Babes-Bolyai Sociologia originates from the panel “Shaping the Field of Romanian Studies: American & Romanian Scholars at Work” chaired by Vintilă Mihăilescu and organized by Iuliu Rațiu at the Conference of the Society for Romanian Studies (SRS), Bucharest 26-29 June, 2018. In line with the general theme of the conference, “#Romania100: Looking Forward through the Past”, the participants, all of whom had done research in Romania, were invited to present their views on what shaped the field of Romanian Studies, with a focus on academic exchanges and the mutual influence between international and Romanian scholars. Three participants in this panel, László Fosztó, David Kideckel, and Steven Sampson have submitted their revised presentations for this issue. Another panel member, Sam Beck, was unable to attend. Viorel Anăstăsoaie attended the panel; finally, Steven Randall did not attend the panel but graciously accepted later to reflect back on his fieldwork experience.

After 1990, the distinction between the public domain and the private domainbelonging to the State and the Local Administrative Units became obvious. Although thefirst decade after the events of December 1989 can be characterized as a decade ofpermissive attitude of the State and Local Administrative Units regarding the exercise ofcertain rights by natural persons and private law legal entities on the goods from theprivate domain thereof, starting with 2000, the legal framework defective in the matterhas been complemented by various imperative legal norms, the previous permissivitybeing replaced by "authority", with the imposition of the exorbitant legal regimeconcerning the goods part of the private domain.The most eloquent example is the legislation on the sale of private propertypremises belonging to the State and Local Administrative Units adopted after 2000,legislation with a certain specificity, legislation that imposed the exorbitant legalregime also concerning the goods part of the private domain, belonging to theseentities. The word negotiation, the concept of negotiation provided in these judicialtexts, has quite a different meaning than the usual one, the meaning of the common law,the negotiation within these procedures being in reality an unnegociable offer.
