Dr. Mihaela Ursa is Associate Professor in the Department of Comparative Literature at the Faculty of Letters, Babeş-Bolyai University in Cluj-Napoca. She is the co-founder of the Transylvania Digital Humanities Centre and the Phantasma Centre for Imagination Studies. Her academic portfolio includes several books published in Romanian on literary comparativism, critical theory and gender studies, and also numerous articles, reviews and essays in vari-ous research areas. Nullity represents the civil law sanction which prevents the contract against the consequences contravening the legal rules established in order to render its conclusion valid and moral. In the matter of civil legal documents, hence in the matter of contracts, nullity is of utmost importance, especially in what concerns law practice that is, in terms of law enforcement by state entitled thereto.The paper approaches some aspects related to the institution of nullity, whether absolute or relative, as it is stipulated by the new Romanian Civil Code, with direct address to the contract, as legal document.

Mythical – Symbolic Meanings of Stone in Folk Thinking

In this paper, the author analyzes the meanings of stone in the peasant understanding. The system of representations is coherent enough and is focused on the primordial gestures of the making of the world by dual couple: God the Father (the one who has no father) and the Unclean (Nefârtache – the one who has a father), the latter being initially subordinated to the former.In this context, the essence of stone as an unfertile and inanimate matter, created by the Unclean together with the creation by God of the fertile world, is followed by the author from antiquity (god Mitras the one born out of stone, the role of the stone menhires of capturers of the souls of the deceased) until the 19th-20th centuries, when the role of soul and bed spirit capture is transparent in numerous Romanian, Aromanian, Slavic and south Balkan beliefs and popular superstitions. This dualist antagonism fertile/infertile, animate/inanimate etc. is also present in the ballad „Meşterul Manole” (Manole, the Craftsman). Any edifice built out of stone, unlike those made of wood, need the finishing of a soul, which can be acquired by the new construction only by the sacrifice of the masons, by the violent death of a grown-up, more precisely of the craftsman’s wife in the above ballad.

The mandate of the owners' association's property manager involves a series of legal and statutory limitations designed to facilitate, on the one hand, a correct management, directed in the exclusive interest of the associative entities and their members, in accordance with the purpose of the Law no. 230/2007 and, on the other hand, to prescribe a pro-active, diligent and efficient conduct in the direction of guaranteeing and recovering debts representing the overdue amounts of living costs. In order to deal with the subject of the mandate of representation and its limits as recognized by the legislator to the property manager, it is necessary to analyze those particular situations, conflicts in terms of interpretation and normative deficiencies. The limitations of the representation mandate or its emptying of content have repercussions in the fulfillment of the professional mission assumed by the administration and the management of the common property.The importance of dealing with the issue is whether or not there is a valid procedural quality of the administrator's representation before the courts of justice in cases concerning the recovery of debts as a result of exercising the mandate in the virtue of being a property manager of the association and also of the duty of acting with honesty, loyalty and legality in the full accomplishment of the beneficiary's interests.
