The repression suffered by the Mallorcan community from the end of July 1936 had great repercussions in the cultural and publishing world of the island. The censor examined all texts that were published, and deleted any content that was not in accordance with the military regime. One of the most curious episodes was the seizure of the novel Marius (1967), by the Mallorcan writer and journalist Antoni Serra.

Censorship is one of the best known mechanisms for social sub mission and repression. The thorough control of critical thinking outside institutional norms and the obstacles posed to the creative freedom of artists have decisively affected those countries that lived under authoritarian govern ments or dictatorships. Censor mechanisms vary in each context and affect each artistic expression differently. This paper aims to explore how censorship affects theater, especially with regard to its dialogic nature, in the relationship between dramatic texts and their staging, as well as its incidence on the creative process of playwrights and the reception of audiences. For this purpose, the study will focus on one of the most repressive contexts in the history of Argentina, that of the last military dictatorship, the self-called National Reorganization Process (1976–1983). During those violent years marked by strict state censorship, a unique theatrical event emerged to face oppression from the stage: Teatro Abierto (‘Open Theater’, 1981–1985). In its first and more rebellious season in 1981, the theater festival gathered diverse artists (playwrights, directors, actors, set designers…) to work together in twenty plays to respond to the censorship with art. The plays began on 28 June at the Teatro del Picadero in Buenos Aires; soon after, the regime understood the social impact of this event. As a consequence, the Teatro del Picadero burned down eight days after the festival had started. However, thanks to social and intellectual support, this was not to be the end of Teatro Abierto; on the contrary, the festival continued with renewed strength at the Teatro Tabaris until September and in subsequent festival seasons. In order to observe the artists’ thoughts on censorship and its impact on the scene, we will consider two texts of Teatro Abierto from the season of 1981: Lobo… ¿estás? by Pacho O’Donnell and Desconcierto by Diana Raznovich.

The paper proposes to trace the evolution of Uruguayan carnival from the viewpoint of left-wing movements, from its beginnings to its evolution as a tool to resist the military and dictatorial government that lasted from 1973 to 1985. In this period the conception of the carnival changed significantly, from being an evasion spectacle to a tool in the resistance movement. Special attention is given to the analysis of the the consequences of censorship in Murga spectacles, as it contributed to the consolidation of the tablado as not only a space for collective entertainment but as a space for political and aesthetic resistance.

The purpose of the article is to present the concept of socialization in organizations, the stages of the socialization process and the theoretical approach to socialization. At the same time, the article particularizes the ways of achieving the professional socialization of the military, the dependence on assuming and assigning roles and the images of the military about these roles. It also addresses the connections between professional socialization and private and civic socialization and the dependence of the real role on the professional and social skills of the military.

During the First World War, heavy fighting took place on the territory of the Cosmeşti village to stop the advance of the German Army. In order to facilitate the crossing of the Romanian troops over the Sereth river, four wooden bridges were built. Also, for the protection of the Romanian troops defense works were carried out, consisting of trenches, barbed wire nets and underground shelters. All this contributed to the protection of the Romanian troops and together they formed an important center of resistance which led to the defeat of the German 9th Army.

Despite the impressive deployment of armed forces on the territory of Cosmeshti commune, the military operations carried out by the Romanian Army in the First World War to defend the positions in this commune were studied very little, and therefore were rarely mentioned in specialized studies. For these reasons, the purpose of this article is to bring to light some of the military operations that took place here a century ago. One of the major military units that took part in the battles for the defense of the objectives on the territory of Cosmeshti commune was the 14th Romanian Infantry Division, whose operations are described in the following pages.

Această lucrare are drept centru modul în care doctrina de acțiuni întrunite a Israelului a evoluat de-a lungul deceniilor, de la crearea statului evreiesc, precum și particularitățile și metodele de îmbunătățire a următoarei etape a acestui tip de doctrină, așa cum se subliniază în Planul Momentum publicat de Forțele de Apărare Israeliene (IDF). Scopul este de a evalua dacă acțiunile întrunite au oferit IDF un avantaj în realizarea obiectivelor strategice stabilite de conducerea politică israeliană, precum și dacă următoarea iterație planificată a doctrinei de acțiuni întrunite israeliană, Planul Momentum, este fezabilă și dacă are vulnerabilități care pot fi remediate. Metodele de cercetare utilizate în această lucrare sunt studiul de caz al conflictelor, în care IDF a folosit acțiuni de luptă de tip întrunit ca metodă principală de desfășurare a operațiunilor, precum și observarea acțiunilor care ar putea împiedica Planul Momentum să obțină rezultatele dorite.

Nivelul crescut de integrare a dispozitivelor și a sistemelor electrice și electronice în domeniul militar a condus la dezvoltarea unor metode mai bune de utilizare a informațiilor în timp real, dar, în același timp, a introdus noi vulnerabilități pentru exploatarea, degradarea și eliminarea fluxului de informații între unitățile militare și/sau diferite tipuri de sisteme de arme. Scopul acestei lucrări este de a identifica conceptele și metodele principale de utilizare a războiului informațional, în special, operațiile CEMA (Activități Cyber Electromagnetice), de către forțele armate ale diferitelor națiuni (Statele Unite ale Americii, Republica Populară Chineză și Israel) și să formuleze mai multe evoluții potențiale în ceea ce privește viitorul operațiilor informaționale.

Internal application and social functions of the orchestras of different military formations on the territory of Ukrainian lands during the first half of the XXth century had their own history, including Lviv Region. This Region as the whole Galicia had gone through the numerous political transformations and changes of political systems. Each of such transformation put forward new requirements to the military musical art, thus, to the activity of military conductors. The aim of the article is the analysis of the tasks, demands, social and cultural background of the conditions of work, potential audience, the peculiarities of performance repertoire, professional training of the membership of the orchestra companies and the conductors of the orchestra’s groups of the Regular Army during the first decades of the XXth century. Such investigation based on historical, structural and systemic methods has been made for the first time. The military subunits of Lviv region of the period of Austrian regime (infantry regiments 10, 15, 23, 30, 55, 80) involved in their units Germans, Czechs, Austrians, Hungarians and less numerously presented Russians and Poles (55 and 80 infantry regiments that had their headquarters in Lviv and dislocated partially in Stryj and Zolochiv). Each of them obligatory had their own musical groups: mainly brass or competent symphony orchestra which included numerous Czech musicians and trumpeters as a separate unit. Each orchestra performer, as a rule, played two different instruments (brass and stringed). Their work was supervised by bandmaster and warrant officer – tambour major (who supervised group’s training as a conductor of the orchestra and their preparation to the defile), they were mainly Austrians, Germans and Czechs. Besides applicable military functions the orchestras took part in the civilian ceremonies, divine services and funeral ceremonies, every week at holidays and Sundays they carried out unmounted and hoarse defile along the city with march and light music of European authors under arrangements of their conductors (namely, arrangements of folk songs and dances), performed programs of European classical music in concert halls; and in public places: in park platforms, skating rigs; they also made guest-performance tours to the recreation resorts. In 1918 with the formation of Polish State there were some transformations in musical sphere of Polish Army and the USS Army. The conductors of military orchestras of Lviv region of the first decades of the XXth century faced the vast complex of tasks: the ability to work with the variety of personnel in the open air (in the field), in the square, hoarse defile and unmounted defile) in the covered concert-theatrical, theatrical buildings; mastering, providing, creation and adaptation of the universal repertoires to the real performance, potential and concert conditions, ensuring the training conditions of the new generation to the range of professional orchestras of academic level, the creation of programs, which provide with image and representative functions of the army, as well as to satisfy the needs of social and cultural topicality.

Singura actualizare a pensiei militare pe care o face Casa de pensie în art.59 – 60 din Legea nr. 223/2015 se face în funcţie de ultima rată medie anuală a inflaţiei, indicator definitiv cunoscut la începutul anului în curs, comunicat de Institutul Naţional de Statistică. Cuantumul pensiilor militare de stat se actualizează ori de câte ori se majorează solda de grad sau salariul gradului profesional şi/sau solda de funcţie/salariilor de funcţie al militarilor, poliţiştilor şi funcţionarilor publici cu statut special, în procentele stabilite la art. 29, 30, 108, în funcţie de vechimea valorificată prin ultima decizie de pensie. Reclamantul a solicitat reactualizarea pensiei militare având în vedere că salariul minim garantat în plată a fost majorat faţă de nivelul anului la care a fost calculate pensia. Nu există text de lege care să susţină o astfel de operaţiune.

Doar personalul militar care are calitatea de cadru militar este învestit, în această calitate, cu exerciţiul autorităţii publice, conform dispoziţiilor art. 1 alin. (1) şi art. 6 alin. (1) Legii nr.80/1995 privind statutul cadrelor militare. Cum din prevederile Legii nr. 384/2006 rezultă că soldaţii şi gradaţii profesionişti nu au statut de cadru militar, nu sunt numite prin act administrativ, ci sunt angajaţi pe bază de contract individual de muncă conform art. 1 alin. (2) din această lege şi beneficiază doar punctual de anumite drepturi acordate de lege cadrelor militare, reclamantul nu a avut calitatea de funcţionar public în cadrul pârâtului pentru a fi competentă instanţa de contencios administrativ.

Potrivit art. 382 din Codul Administrativ, adoptat prin O.U.G. nr. 57/2019, din Titlul II: Statutul funcţionarilor publici „Prevederile prezentului titlu nu se aplică următoarelor categorii de personal bugetar: (...); h) personalul militar;”, iar potrivit art. 43 alin. 1 din Legea nr. 346/2006 privind organizarea şi funcţionarea Ministerului Apărării Naţionale, „(1) Personalul Ministerului Apărării Naţionale este format din personal militar şi personal civil.” Ca urmare, devin aplicabile prevederile art. 1 alin. (2) din Codul muncii, adoptat prin Legea nr. 53/2003, în conformitate cu care: „Prezentul cod se aplică şi raporturilor de muncă reglementate prin legi speciale, numai în măsura în care acestea nu conţin dispoziţii specifice derogatorii.”

Legiuitorul nu îngrădeşte dreptul pensionarului de a beneficia de o pensie stabilită după principiul contributivităţii. Dacă însă, în locul pensiei stabilite conform principiului contributivităţii, pensionarul alege să beneficieze de o pensie de serviciu, aceasta intră sub ocrotirea unei formule de calcul care derogă de la principiul contributivităţii. Or, nu se mai poate invoca acest principiu, când se iese de sub imperiul lui. Contribuţia pentru pensia suplimentară a fost o reţinere obligatorie făcută de angajator din veniturile salariale, care s‑a înscris în categoria sarcinilor fiscale şi care nu are semnificaţia unui depozit (în acest sens fiind şi decizia Curţii Constituţionale nr. 956/2012), chiar dacă se depunea la CEC într‑un cont purtător de dobândă, întrucât depunătorii nu au putut niciodată revendica acele contribuţii, iar beneficiul unei pensii aferente ei a depins întotdeauna de cadrul legislativ aplicabil pensiilor. Apelantul beneficiază însă de partea de pensie aferentă contribuţiei sale pentru pensia suplimentară, deoarece pensia sa de serviciu, aflată în plată, este într‑un cuantum superior celei calculate anterior în respectul principiului contributivităţii. Prin urmare, apelantului nu i s‑a confiscat nimic.

Potrivit dispoziţiilor art. 7 alin. 1 lit. b din Capitolul 2 Anexa II la Legea nr. 153/2017 personalul de specialitate medico‑sanitar si auxiliar sanitar din unităţile sanitare si unităţile medico‑sociale care îşi desfăşoară activitatea în leprozerii, anatomie patologică, TBC, SIDA, dializă, recuperare neuromotorie, neuropsihomotorie, neuromusculară şi neurologică, psihiatrie, medicină legală, asistenţă medicală de urgenţă şi transport sanitar, acordată prin serviciile de ambulanţă şi structurile de primire a urgentelor (UPU ‑ SMURD, UPU, CPU), beneficiază de un spor pentru condiţii deosebit de periculoase de până la 85% din salariul de bază.

Ordonanţa de urgenţă nr. 99/2017 a instituit norme de drept temporal, derogatorii de la normele cu character general. Cu alte cuvinte, intrarea în vigoare a dispoziţiilor OUG nr. 99/2017 nu au modificat dispoziţiile Legii nr. 223/2015, ci au înlăturat de la aplicare, pentru perioada în care Ordonanţa nr. 99/2017 se aplică, dispoziţiile care reglementează actualizarea şi indexarea pensiilor militate, aceste dispoziţii fiind înlocuite temporar cu dispoziţiile prevăzute de norme de drept temporar, respectiv pentru anul 2017, nu sunt aplicabile dispoziţiile privind actualizarea şi indexarea pensiei militare, ci majorarea cu 5,25% a pensiilor militare. În consecinţă, modificarea dispoziţiilor art. 59 din Legea nr. 223/2015 prin dispoziţiile OUG nr. 59/2017 nu produce nici un efect asupra normei derogatorii inserată în art. 12 din OUG nr. 99/2017, aceasta găsindu‑şi aplicabilitatea, independent de dispoziţiile de modificare a Legii nr. 223/2015 pentru întreg anul 2017.

ÎNALTA CURTE, deliberând asupra recursului în interesul legii, constată următoarele: I. Sesizarea Înaltei Curţi de Casaţie şi Justiţie şi obiectul recursului în interesul legii 10. Înalta Curte de Casaţie şi Justiţie a fost învestită prin sesizarea formulată de Colegiul de conducere al Curţii de Apel Bucureşti cu soluţionarea recursului în interesul legii ce vizează următoarea problemă de drept: „În interpretarea dispoziţiilor art. 108 din Legea nr. 223/2015 privind pensiile militare de stat, cu modificările şi completările ulterioare, şi ale art. 11 alin. 3 din Legea nr. 80/1995 privind statutul cadrelor militare, cu modificările şi completările ulterioare, coroborate cu cele ale art. 28 şi art. 30 din Legea nr. 223/2015, sporul pentru contribuţia la Fondul de pensie suplimentară prevăzut de art. 108 din Legea nr. 223/2015 intră în baza de calcul al pensiei, fiind, prin urmare, supus plafonării prevăzute de art. 30 din Legea nr. 223/2015, sau este un drept care nu face parte din pensie, astfel că trebuie adăugat la cuantumul acesteia?”

In the 21st century, the world’s leading states have moved to the next generation of wars, in which the emphasis is on the strategic confrontation of non-kinetic weapons. Obvious changes in the current security environment, emerging and disruptive technologies generate risks that lead to instability and confusion. Currently, almost all the armed forces of the developed states in their structured composition specialize in creating a psychological impact on military personnel and the enemy population. These structures use a set of methods and means of influencing people to change their psychological characteristics (points of view, opinions, value orientations, moods, motives, attitudes, behavioral stereotypes, etc.) Therefore, in addition to traditional military operations, non-kinetic operations of psychological, informational, cyber, economics etc., are becoming increasingly important because modern technologies are more sophisticated, integrated and interconnected. In this context, we will continue to focus on psychological actions as the main component of non-kinetic operations.

HUMINT is a niche discipline, with a limited number of stakeholders and practitioners. The management of the HUMINT personnel is a complex enterprise that should properly address aspects of career development projection and planning, starting from the selection process, professional development, performance assessments/evaluation, and ending with welfare aspects that can affect individual and group performances. Developing a well-trained and skilled HUMINT operator means that an applicant will be able to manage long life educational process in many different areas (military, economics, psychology, culture, public affairs, human geography, etc.), with ability to deal with permanent physical and mental stress, while preserving its capacity to fulfil all tasks and missions assigned. This is the basis for further professional progress, to senior/ leadership positions, or possible shifts to other disciplines. In this respect, as the HUMINT community within the Military is limited in number, the individual quality of the personnel matters, and each vacant position has to be occupied precisely by the right skilled applicant. The paper further describes the NATO HUMINT COE approach to the selection process and professional development in HUMINT.
