My aim is to analyse the central concepts of Agambenian philosophy, with the help of new waves of interpretation (e.g. Watkin, Zartaloudis and Long Chu): signature, indifference, (im)potentiality (in confrontation with Deleuzian virtuality) and zone of indistinction. This paper is also an attempt to shed a new light on Agambenian theory of power through the analysis of sovereignty, bare life and biopower from a strictly conceptual point of view, that is to say by taking into consideration the ontological basis of Agambenian political philosophy and philosophy of law. A conceptual-methodological approach would perhaps make it possible to get rid of the usual accusations at the expense of Agamben’s philosophy, with a special emphasis on the question of resistance. The central question of this paper is: what makes power operative?

The article elucidates the history of US law, known as Obamacare. Usually you find out that you are eligible for Medicaid when you fill out a health insurance application on the Affordable Care Act (ACA), which passes the information to Medicaid. Because you applied for health insurance on an Obamacare health insurance scholarship, you may be surprised to receive Medicaid instead of a private Obamacare plan. Following the inauguration, Donald Trump signed an order repealing the Affordable Care Act (the Obamacare Act). The decree is symbolic, being the first signed by Donald Trump when he officially took office. This repeal is perceived as a break with the previous government. However, in the face of opposition from the House of Representatives, the text aimed at repealing Obamacare was finally withdrawn on March 24th, 2017, at the request of the new president, who is thus suffering his first major political setback. On May 4th, 2017, the House of Representatives narrowly passed a bill to repeal Obamacare, but the bill was rejected by the Senate on July 28, following a decisive vote by Republican Sen. John McCain, who joined two of the two his fellow Republicans in the vote against repeal. On October 13th, 2017, Donald Trump issued a new decree to circumvent Obamacare. Finally, Donald Trump changed his tactics to repeal the Affordable Care Act, supporting legal initiatives against it, especially in Texas. On the other hand, he made a hobby for the 2020 US presidential election, promising an effective repeal if re-elected, which did not happen.

Old age is difficult to define, so many terms overlap or clash with each other, all of which raise a number of issues: the elderly, the third age, the fourth age, pensioners, etc. It is not easy to determine the threshold for entering the period of life commonly known as old age. One thing is certain, old age has changed profoundly. From now on, it has become for everyone, albeit with profound inequalities, a normal stage of life. Social security systems combined with the considerable progress in medicine have made it possible to increase the length of retirement. Whereas in 1950 a man retiring at 65 could expect to live for about 12 years, today life expectancy at 60 is over 20 years for men and over 25 years for women. However, this simple observation has much more complex consequences in terms of the social identity, integration and social behaviour of these new population groups. Despite an ageing population, Switzerland has a total labour force of 4.706 million people. In the fourth quarter of 2019, the participation rate of the population aged 15 and over was 68.1%. This puts the country in second place in Europe behind Iceland (79.9%). Switzerland's neighbouring states have significantly lower levels (Germany: 62.6%, Austria: 61.4%; France: 55.5%, Italy: 49.9%). In particular, Switzerland has one of the highest rates of employed women in Europe. The percentage of employed women increased significantly between 2010 and 2019, from 56.9% to 60%.

In this paper, we studied scamming emanating from the use of free Android apps by conducting an online survey with respondents recruited from four tertiary institutions in Kebbi State, Nigeria. We found that the apps used for communication, such as Facebook and WhatsApp, have the highest number of users. Also, 55.26 % of users reported receiving scam messages that could be linked to their use of free apps, whereas 32.45 % of them were indeed defrauded by scammers. The study concludes that the free social media apps coupled with the characteristic of the users’ login credentials could be responsible for the high rate of scam messages that the respondents receive regularly.

Trade union organizations/elected representatives of employees, in their capacity as subject of collective labor relations, may abusively exercise their subjective rights both at the time of conclusion and at the time of modification, suspension and termination of the collective labor contract. A special situation emerges in the case of the abusive exercise of the right to the association and the abusive exercise of the right to strike and the rights of trade union organizations, of the elected representatives of employees, as the case may be. The right to strike, being a means of ensuring collective negotiations, cannot abusively harm the interests of the other party. In the following article, those situations of abusive exercise of the right to strike will be highlighted, wherein the limits of the exercise of this right are intentionally exceeded by the elected representatives of the employees. Starting from the idea that the strike is declared in order to protect the social interests of employees, the abusive exercise of the right to strike must be evaluated taking into account the prejudicial result of the strike in relation to the organizers' intention and interest to produce this result.

The article analyzes the phenomenon of human and social aging, in an attempt to answer several questions related to social evolution. What principles should govern the relationship between the individual and society, and how far do our obligations to others extend? To what extent should the state intervene in market regulation? How does social change happen and how can the law ensure that everyone has a voice? The distinction between traditional rural communities and modern industrialized society is analyzed through the lens of Ferdinand Tönnies theory (German sociologist and philosopher, 26.07.1855 - 09.04.1936), wich points out what the distinction between traditional rural communities and modern industrialized society. The former are community that is based on the bonds of family and social groups such as the church. Small-scale communities tend to have common goals and beliefs, and interactions within them are based on trust and cooperation. Tönnies’ theory, along with his work on methodology, paved the way for 20th-century sociology.

The phenomenon of sirri polygamous marriages, or without the permission of a legal wife and without the permission of the Religious Courts, common in Banjar Regency, South Kalimantan Province, still raises arguments for and against. Originally the meaning of sirri marriage was intended for the case where the conditions of marriage were not met, but now it has been extended to marriages that meet the conditions but have not been registered with the religious affairs office (KUA) of the sub-sector for those who are Muslim. The purpose of the study was to elucidate the constitutional rights of wives and children who were neglected as victims of polygamous marriages in Banjar Regency. This research is a type of empirical legal research with statutory, case and conceptual approaches. The results of the analysis show that sirri polygamy has an impact in the form of constitutional losses for spouses and children. If a polygamous marriage has received permission from the first wife, then the sirri wife can be well received and does not receive social sanctions in society, as well as the children of sirri polygamy are well received and equal in society. Sociologically, a child of a qualifying sirri polygamous marriage is legitimate, so the legal relationship between the child and both parents is one of kinship and inheritance. The constitutional issue for children of sirri polygamous marriages takes the form of legal issues related to identity rights. This is inseparable from the usual factors in an area, where for the Banjar community children born in wedlock, whether Sirri or registered, are considered legitimate children.

The purpose of this paper is twofold: to argue for the value of (1) social science as part of the intellectual activity of writing (rather than righting) and (2) the practice of fiction to that intellectual activity. Writing is a mode of representation that eludes our complete and objective knowledge and always remains partial and temporary. While righting, in contrast, is concerned with the absolute truth and the revelation of the right answer. This paper argues that writing is a more productive, creative, and necessary way of engaging with reality than righting, and that it can offer insights and perspectives for both theory and praxis. Drawing on Stephen King’s view on writing fiction, this paper will also argue that fiction constitutes a kind of writing and employs a particular form of truth that is conceived as a relation between representation and reality. The paper will conclude by suggesting the need for criminologists—and social scientists more generally—to adopt the perspective of writing to gain a better understanding of the phenomena with which they are concerned.

Axiology is one of man’s indicators in the journey he undertakes to find the answers to the fundamental challenges of life. Considering the finite nature of earthly life, on the one hand, and the transcendence of the human being towards an infinite and heavenly life, on the other hand, man finds and faces, in his searching, a paradox, in that when the truth sought is finally defined, it is actually only the beginning of the journey, because the truth is not a concept but a person, being of divine nature. Thus, thanks to this search – on which in the end he will admit that it is still due exclusively to the divine revelation – the man discovers other answers, and in the case of the present article, the knowledge regarding the identity, the crisis and the restoration of human being, the divine immanence and his supremacy over the all Creation, becomes relevant through the quality of containing in itself the divine pathos and praxis. This search finds its expression and materialization, in an obvious and expressive way, in the field of education, a field that will be addressed in this article.

In the era of a new sexual revolution marked mainly by coital overstimulation (Melzer 2019: 32) and sensory exploration through practices offering new uses of the body (Breton 2017: 188), the designation of an entity in the mental representa tion that exists in the extralinguistic world seems extremely striking, especially with regard to the construction of anaphoric reference in new media. In this regard, it is important to note that at a time of body worship reinforced by the use of new technologies, various manifestations of love are popularized on social networks as well as on thematic sites that have become essential to strategies of effective marketing. Among these web pages, there are very specific portals, namely those with pornographic content, called X pages, where one can very easily have access to numerous photos and videos allowing users to satisfy different carnal appetites. In deed, it turns out that the immense popularity and, therefore, the effectiveness of these web portals today is not limited only to their visual side, although it is, of course, the image that plays a key role here. Analysis of a particular genre of external pornographic discourse (Paveau 2014: 50) that we propose in this paper is based on a corpus for which we have collected diastratic variational material from non-standard language, namely a hundred information sheets, referred to as erotic biographies of 93 gay and bisexual porn actors, gathered on the French-speaking site https://www.videosxgays.com. The objective of our study is to analyse the functions of sex slang apprehended through anaphoric references, which are ex pressed in multimodal texts with a persuasive vocation, where images, films or photos play a key referential role. In short, we will try to highlight the discursive effects that this linguistic variation seems to produce by exploiting the anaphoric reference in a particularly persuasive context, with its enormous range of specific lexical and stylistic means: periphrases, metonymies, hyperboles, etc.

This paper aims to explain the effect of the post-truth on revisionism in Just War Theory. Revisionism in JWT is based on the claim that Jus ad Bellum and Jus in Bello cannot be separated and that only combatants who fight on the just side are morally justified in killing. Presupposition of this argument is that combatants can and ought to know the moral status of their side. This paper will demonstrate that it is impossible to demand combatants to know whether their side is just by investigating the implications of post-truth in modern conflicts. By demonstrating the practical impossibility of combatants to know whether their side is just, author will show that the assumption of inculpable ignorance in war must remain the essence of JWT. Posttruth phenomenon only fortifies the necessity of separating Jus ad Bellum from Jus in Bello and upholding the principle of moral equality of combatants in contemporary wars.
