This article aims to analyze the rules of Lex Rhodia de iactu, which consider the situation of throwing goods overboard by the captain of the seagoing ship to save the ship and distribution of damage among owners of goods. The paper, however, is not limited to the research of the considered norms, but also extends to the way in which these norms inspired the modern commercial codes.

The Moldavian Code from 1646 and the Wallachian Code from 1652 belong to a codification movement that started in Western Europe in the XVIIth century. They comprise, in general, the works that gather the positive law texts according to the nature of their source. As to the criminal dispositions from the Moldavian code, their only source is a Neogreek abstract of the work of the Italian criminal specialist, Prosper Farinaccius (Praxis et theoricae criminalis) which will equally be integrated by the Wallachian code. The article presents the Roman sources of the two codes regarding the person, related to the works of Farinaccius.

Alternative procedures to the judicial way existed in the Roman Law to solve controversies; many of them emerged in the family environment and in the business world. At present, through Mediation, Negotiation and Arbitration (Alternative Dispute Resolution – ADR), more favorable agreements can be obtained for the interests of both parties. In addition, these ADR methods protect privacy and avoid distress that damage the health and destroys the future relationships between the parties. The objective of this work was to compare the alternative strategies existing in the Roman Jurisdiction with the ADR methods used at present. This meta-analytical study consisted in the bibliographic revision of roman documents to compare them with the sources of current Law. The results inform that, in both, Roman Law and Current Law, alternative strategies like ADR, offers important advantages to the judicial way. They can be highlighted: the preservation of privacy, the good reception of the resolution by the parties, a more positive management of emotions, and a preservation of good relations between the parties. Both in Roman times and in our times, these aspects have special relevance in the field of the family and also in private businesses.

The Theodosian Code has been object of many studies in the last thirty years, therefore repeating a comparison between Theodosian Code and Justianian Novus Codex seems of considerable interest. So topics that induce to consider CTh. 1.1.6 merely interpretative of CTh. 1.1.5 are studied in this perspective (the most cogent reason is represented by the issues arisen by the Commission in charge of selecting of the western normative material arrived in Costantinopoli almost certainly before 435). In conclusion it seems right to consider Codex published in 438 to be actually the achievement of the first part of the project elaborated in 429. At last the author formulate hypothesis about the reasons why the project of drawing up the Codex magisterium vitae had been abandoned (abandon decided in 435 when codes took the name of the emperor). In relation with Novus codex the author examines the project formulated in 528, the chancellery’s legislative activity during the code editing and the Summa’s provisions related to the legal writings. The conclusions achieved by the author are verified basing on laws regarding writings of classical legal authors dated between autumn of 529 and summer of 530. This exam suggest hypothesis about the decision of editing the Digesta.

With the entry into force of the Interim Agreement in 2005 between the EU and Albania, Albanian judges had the obligation to partly apply several provisions of the agreement (the EU law) even in the pre-accession stage. This position was reinforced in 2009, with the ratification of the Stabilisation and Association Agreement, which laid down the obligation of the Albanian government to approximate its existing and future legislation in line with EU acquis and ensure proper implementation. Consequently, as of 2009, Albanian courts had to apply the EU law. The application of the EU law by Albanian courts entails the duty of judges with a twofold task: firstly, to construe their arguments in line with EU law or as close as possible, and secondly, to set aside the domestic law which is found to be incompatible with the EU law. This paper outlines some Albanian courts' decisions concerning applying the EU Law before accession to the European Union. The paper argues that Albanian judges have adopted a ‘Euro-friendly’ approach by referring to the EU Law and SAA agreement even in the pre-accession period. Nevertheless, looking closely at court decisions, the EU law is applied as a persuasive source of law to support the court’s decision and not to explain the importance of relying on EU law or CJEU case law.

In an attempt to properly address one of the greatest challenges for prison administrations around the world facing Covid-19, namely, to ensure regular communication between the inmates and their families, the Serbian Penal Administration, supported by German NGO Help e.V, procured the ICT equipment aimed at substituting the in-person visits. The author decided to assess the impact of this pilot project on the right of inmates to communicate with their family members, exploring their attitudes and the attitudes of professionals/prison staff that work with them, to get both perspectives. The results of the research showed that the online communication ensured through the pilot project has significantly contributed to preserving contacts and family relations in the changing environment of the Covid-19 restrictive measures, although it cannot completely replace family visits based on, in-person contact. However, the research also led to some of the remaining obstacles to a wider application of this, substitutive approach, among others, concerning the lack of IT literacy and the both of inmates and their family members, and to the life in poverty and/or in remote country areas. Additionally, this research identified a remaining need for further financial investment in the IT equipment to ensure adequate frequency and duration of communication, but also the need to revise/upgrade an existing treatment approach to integrating modern technologies/IT literacy as tools to contribute to the effectiveness of inmates’ reintegration.

The patrimonial liability is the most common form of liability, being attracted in case of non-compliance with the legal norms, in order to protect the social values indispensable for the normal functioning of a company. Legal employment relationships are one of the most common areas in which joint and several liability is applied, namely in the case of work accidents resulting in personal injury to employees, which can cause them including permanent disabilities and can be caused by deficiencies in specific equipment used, as well as the lack of effective training in the field of labour protection. Establishing guilt and attracting civil liability is done in relation to the concrete conditions of the accident, the duties of employees according to job descriptions, but also the concrete actions they performed during the program or in connection with work duties. The article presents the applicability of the legal norms in the matter of civil liability to a practical case in which the courts have held joint and several liability of employees and employers in case of accidents at work, referring to the legal conditions to be met, with implications in criminal law.

This paper assesses the impact of the decision of the German Federal Constitutional Court of 24 March 2021 on German and European legal regulation in the field of climate protection. The main thesis argues there is a need to change both legal regimes towards a decisive reduction of carbon dioxide emissions. The climate provision has given new impetus to the challenge of ecological transformation, which the German legislator has thus far been unable to meet. Although the Court found the existing regulation of German law to be compatible with the Constitution, nevertheless, as global warming intensifies, the requirements to strengthen environmental protection may increase, and the Court is likely to subject existing legal regulations to more rigorous review. There is currently much speculation in the scholarly literature concerning the significance of the Federal Constitutional Court’s ruling. Ultimately, however, the question of whether this ruling will remain a special case or will initiate a line of jurisprudence towards greater intergenerational justice will only be answered by future judicial decisions.

The phenomenon of Swiss franc mortgages in Poland revealed the ineffectiveness of consumer rights protection and a misunderstanding of the EU idea of balancing consumer contractual rights and obligations towards the trader. The lack of a systemic solution to this issue has led to the fact that currently persons with debts in Swiss francs are in dispute not only with banks, but also with that part of the society which feel disadvantaged by the fact that contracts containing abusive clauses have become cancelled. The PLN borrower’s perspective does not take into account the key factors that determined this pattern of events (even while ignoring the fact that it is not the court’s ruling that makes the mortgage agreement invalid). This article presents and discusses the factors thanks to which the expansion of loans indexed with the CHF rate in 2004–2010 was possible. Based on this analysis, the author proves that unequal treatment of consumers in access to the credit services occurred at that time, and that currently pending litigation cannot take into account the principle of social justice, which does not include goods or services over which the state has no influence, when applying distributive mechanisms.

The legalization of same-sex relationships has always been a controversial subject. Ireland is a good example of such a case, which decided to legalize same-sex marriages following a referendum held in 2015. Conclusions which stem from the Irish experience in this matter can provide valuable lessons for those countries that have not yet legalized one-sex marriages. The subject of this article is an analysis of the path that Ireland has undertaken to legalize same-sex marriages and an indication of current Irish regulations concerning these marriages. The aim is to discuss legal evolution of the institution of same-sex marriages in Ireland and its consequences for the constitutional order and social perception of the Irish citizens. Due to the fact that there is a lack of complex legal research of this subject in Poland, this article constitutes a gap-filling study. The article has a scientific and research character and may constitute a contribution to further legal considerations on the issue of same-sex marriages in the EU states.

The Romans didn’t develop a dogmatic analysis of the right to property. They are the jurists of the Middle Ages and the modern era which, starting from the scattered texts of Roman law, formulated an absolutist conception of property. Whether, originally, the dominium ex iure Quiritium corresponds to a quasi-sovereignty, it is more a power than a right of appropriation in the modern sense of the word; and property was never considered in Rome as an unlimited power in time and in space. This right has, in fact, suffered significant infringements depending on political and economic history. First, it is a legal limitations based on the public interest and the necessities of town planning as well as on the idea of abuse by right. Another form of violation of the absolute right to property has been the multiplication of situations of de facto property, who have benefited from the judicial protection of the magistrate. On the other hand, Roman law offers the example of a sovereignty shared ownership: due to dismemberments, usually temporary, with personal easements, but especially with long-term land leases– superficies and emphyteusis - which lead to a real dissociation of ownership real estate.

The present study discusses issues related to the relinquishment of the right to property, provided for in Art. 100 of the Property Law, and of property rights over a third party’s property as legally regulated manner of disposing of the right to property. The aspect in consideration is the two-element mixed factual composition of the renunciation of the property right, provided for in the law: the unilateral declaration of will of the holder of the right, aimed at its termination on a given immovable property and its registration. A general consequence of the renunciation is that the property becomes unowned, but there is no direct regulation by whom and by what means it is acquired. Both the relinquishment of a co-owner of their ideal part of property and the relinquishment of an owner solely of their ideal part of property have been considered. The emphasis of the exposition is placed on the effect of the entry of the waiver of a subjective right, as well as on the consequences of an actual waiver of a property right under Art. 100 of the Property Law, mainly on basis of whom the right belongs to after such a waiver. Inquiry is placed on the suggested permits, that the properties, for which a consent is given to waiver of property rights: increase the shares of the other co-owners; remain unowned and subject to conquest; become state, respectively, municipal property. An original claim that such properties become state/municipal property is substantiated by application by analogy of Art. 11 of the Law of Succession and of texts of particular laws, apart from the foreseen prospect for the municipality to seize the property and acquire it by prescription.

The article reveals the nature and the application of one of the main claims for defense of possession - the claim under Art. 76 of the Property Act (PA). The claim originates from the canon law, where it was known as actio spolii. The claim under Art. 76 of the PA protects the deprivation of possession, carried out in two qualified forms – by violence or in a hidden way. The current article draws attention not only to the main theoretical views, related to the nature and application of the claim, but also to the contemporary views and the application of the claim in the case law. The article also shows the author's personal opinions on issues differently interpreted in the theory and the case law. In the light of the abovementioned, the article may be useful to both theorist and practicing lawyers.

The prescription of criminal liability presupposes the extinction of the criminal legal relationship appeared as a result of committing a crime due to the fact that it was not committed within a certain term established by law, which affects and empties the idea of criminal repression and prevention. The main objective of this research is related to the exposure of the effects of the Decision of the Constitutional Court no. 358/2022 with reference to Decision no. 297/2018 by which the phrase “by fulfilling any procedural act in question” from the content of art. 155, paragraph 1 of the Criminal Code, especially from the perspective of multiple issues that may be defended in practice, which also determines the possibility of the existence of a judicial error. The article analyses the content of the two decisions of the Constitutional Court, but also their implications identified in the practice of the courts, taking into account the importance of respecting the principle of legality, but also the observance of the rights of the parties in a criminal trial.

In order to improve the efficiency, accountability and transparency of the judiciary and to create a modern and comprehensible judicial system in modern conditions, especially during the state of emergency caused by the Covid-19 pandemic, it is necessary to upgrade the existing ones or build modern information systems for the judicial system. The application of these systems in cyber courtrooms, in criminal proceedings and in the judicial system as a whole would allow: optimization of human resources; rationalization of financial resources; automation; reducing, as far as possible, the impact of the human factor on the effectiveness of the judiciary; reduction of paper documentation and introduction of electronic data and their electronic exchange between the judicial authorities and other state institutions; and protecting the health and safety of people during an emergency. Such changes require a normative determination of "different conditions for conducting" the criminal proceedings and their introduction into the positive legal framework.
