Summary/Abstract: The author analyses presumptions on that the new Constitution of Bosnia and Herzegovina may be built in the context of social and political constellation. Not entering in the problem of constitution matter as it will be set in the new Constitution, the author indicates some main characteristics that the new Constitution must have. So he says that the new Constitution have to be: a constitution which could be brought by new originated constitutional authority; a short constitution; a normative constitution, because only a normative constitution has a chance to be a real one and effect in a society; a democratic constitution, because a democratic constitution is one that restricts authority and gives a responsible government; a strong constitution, because a strong constitution in formal sense and, at the end, a modern constitution, which main subject has to be an authority and a human being.
