Summary/Abstract: The will of the deceased, the limits of the right of disposal of third parties to the body or funeral of the deceased. How faith lasts beyond death. In Romania, the state guarantees the freedom of conscience of citizens, freedom that is manifested by their right to think freely, to have their own opinions, political choices or religious beliefs. The public manifestation of a religious beliefis part of the fundamental right to human dignity. One of the fundamental human rights is to choose his own religion or to change it, to live according to the dogmatic, ethical and social norms of his religion and to be able to decide on his own body or funeral. The Romanian courts have ruled that even in the absence of an express provision, membership in a religious organization or the public manifestation of the beliefs of that religion are sufficient reasons for determining the manner of burial: with or without cremation.
