Summary/Abstract: On the Enlightenment principles of civil tolerance social, political and religious pluralism was founded. The ideology of religious pluralism is more than a minimal recognition of religious diversity in a given socio-political context. The republican political tradition considers that religion is circumscribed to the private sphere, and thus “requires” citizens to refrain from certain public acts considered to be religious in the public space. While the Church is trying to show that religion is indispensable to modern man, the State cannot prove that religion, or the means that sustain faith, exist on its political agenda, although it collects taxes from all its members, without exception. In theological-political terms, the status granted by a modern state to religion can easily be deciphered at the first level of consistency through the analysis of law. In this context we intend to analyze the status of religion in the contemporary European State, taking into account the fact that the diversity is a very important value in determining the relationship between the Church and the modern State.
