Once again on the mandate of the syndic judge within insolvency proceedings – art. 45 paragraph (1) letter o) of Law no. 85/2014

Summary/Abstract: Creditors are mainly tasked with active involvement in the insolvency procedure, so that the procedure can succeed. However, when creditors are passive or involved in the activities of the bankrupt debtor, which results in blockages of the insolvency procedure, the syndic judge will overrule, in some instances, the will of the creditors, as their task is to make the decisions imposed by the situation.
