Summary/Abstract: Directive (UE) 2019/10231 allows states to decide the moment in which an administrative or judicial authority can or should intervene in insolvency prevention procedures, whether these procedures require validation from a court of law or other authorities and, should validation become necessary, the most suitable moment to seek it. Romanian lawmakers have chosen minimal intervention from courts in the procedure for restructuring agreement, allowing for challenges that can only be issued after the restructuring plan/agreement has been confirmed.
