The control of legality, between (us) the competence of the syndic judge and the limits of investment

Summary/Abstract: The evolution of the legal provisions governing the role of the syndic judge, both in the insolvency proceedings and in relation to disputes that cannot be resolved by him, has led to doctrinal debates, non-unitary practice and has been the subject of public debate. This article summarizes some of the ideas expressed by practitioners who have dealt with this topic, those derived from the decisions of the Constitutional Court and the High Court of Cassation and Justice in order to highlight some landmarks considered useful and relevant in setting boundaries of the implicit competence of this institution.
