Summary/Abstract: The Rome Statute of 17 July 1998 of the International Criminal Court provides in Article 8 "War crimes": the act of intentionally launching an attack knowing that it will cause incidental loss of civilian life, injury to civilians, damage to civilian property or widespread, long-term and severe damage to the environment, which would be manifestly excessive in relation to the overall concrete and direct military advantage anticipated. However, the retrospection of major events in human history shows that people are capable of irreparably destroying their environment even in peacetime. As such, any behaviour that causes massive damage to biodiversity should be criminalised to the extent of its gravity on a global scale and sanctioned exemplarily, because it is the environment that ensures the existence and longevity of the human species.
